Villa Rental Terms And Conditions

  • Booking requirements. To confirm your booking we require a 100% pre-payment at the moment of making your reservation. A $2,000 USD damage deposit is required upon arrival in cash and will be refunded 48 hours after the departure, upon satisfactory inspection of the property. Also, please be advised that the 5% service charge, of the total spend, also will be required to be paid in cash up on the departure.
  • Reservations. All booking and payments are valid upon the 50% deposit is paid and confirmation by PLAYAAKUN management via email.

Sian ka’an entrances are not included (approx.$9 USD PER PERSON-PER DAY, subject to the change by National Park of Biosphere without prior notice) please do pay on your arrival and register with the park guards as you might not be able allowed to enter again if you fail to do so.

Property Use

‍Property can be used exclusively for residential purposes ONLY and any kind of events, including weddings, video footages, photo-shootings, among others (previously arranged with the owner and with an extra fee), but not limited to, and any event different from residential use to be held at the Property, will require previous written authorization from NCN Houses & Hotel LTD S.A. de C.V. (“PLAYAAKUN”). Under no circumstances, people different from Clients who were originally indicated to PLAYAAKUN as authorized to stay over and use the Property, will be allowed to do so. Failure to comply with the proceeding and/or any of these Property Use Terms and Conditions, will entitle PLAYAAKUN to terminate immediately Property use without reimbursing any amount to the Client and consequently, Client and their company must leave the Property immediately.‍

Security Deposit

To assure the partial compensation for any losses of damage, caused to the Property or any of the equipment and third party services, by the clients and/or their third parties, the Client has to pay PLAYAAKUN or relevant agency a security deposit (the “Deposit”) as written in the paragraph #1. In case such damages to the Property, the equipment, third party services caused by Client or their third party, cannot be covered by the Deposit, the Client is bound to indemnify NCN Houses & Hotel LTD S.A. de C.V. (“PLAYAAKUN”) legal representative Claudio Catanzaro, as an Indemnified Party, as well as to compensate the damage up to the satisfactory level in order to prevent any demand, loss, damage, cost and expense (including any lawyer fees). The Deposit will be refunded at finalization of Use Term upon a satisfactory inspection of the Property and equipment

Included Amenities:

  • Wi-Fi connection;
  • Daily Room keeping and ONE change of bedsheets for the booking of 7 days or more.
  • The towels will be changed every THIRD day, due to the Eco villa requirements.
  • Bathroom amenities. (shampoo, conditioner, shower gel, sun cream, mosquito repellent)
  • Property comes with room keeper, maintenance staff and property security.
  • Any changes to the standard service might be restricted and with an extra charge.

NOT INCLUDED:

  • Chef and food pre-stock – available on request ($200 usd a day /not festive season)
  • Barmen-waiter services – available on request ($150 usd a day /not festive season)
  • Concierge / major domo – available on request (depends on the availability)
  • Personal security – available on request
  • Transportation - to and from airport and daily use – need to be pre-booked in advance.
  • Alcohol
  • Personal laundry service
Restrictions
  • The booking payment is only for the registered guest. ANY of the extra guests at any time in the property needs to be authorized by the property owners in advance and will have a fee of $200 USD per day.
  • Due to the Sian Ka’an Nation Park Rules and Regulations the sound level of music and entertainment that is not affecting the surrounding flora and fauna.
  • The property is NO-SMOKING.
  • Sub-leasing the Property is not allowed for the Client; No negotiation and/or cancellation will be agreed with Personnel members;
  • NO pets allowed;
  • No unauthorized party is allowed. The owners need to authorize all the party\ies in the property and see if they are not breaking any rules of the National Park of Biosphere.
  • Performing or allowing any illegal acts and/or contrary to good manners and/or which may compromise Property stability, safety, hygiene or comfort and avoiding any omission also causing said results, are prohibited.
  • There is not allowed to trash paper or any kind of trash to the toilets, the house has an ecological drainage system. There will be a penalty of USD 5,000 if the drainage system results are damaged because of bad use during the guest stay.
Parties Liability

The Client releases PLAYAAKUN from and PLAYAAKUN is not responsible and will assume NO fault or cost associated with:

  • Any complaint, damage, expenditure or any other financial loss- either related to a person or property that has been the result of a wound, accident, death, delay, alteration of dates or inconvenience, by any cause, including problems related to delays or cancellation of transportation, or due to inclement weather;
  • The wellbeing of any person with respect to any accident or other occurrence that may happen to them related to Property use;
  • Any damage caused by any natural disasters including, but not limited to, tropical storm, earthquakes, hurricanes, floods, and landslides;
  • Any damage to the Client’s goods, including his/her/their wardrobe when using the laundry services;
  • In general, any type of responsibility resulting and/or derivative from, related to Property use. Consequently, the Client hereby waives to take any action, claim, complaint and/or remedy, of any kind, including but not limited to civil, criminal, labor and administrative, against PLAYAAKUN their legal representatives, shareholders, directors or counselors, related, affiliated or subsidiary companies, and their respective legal representatives, shareholders, director or counselors, including but not limited to any responsibility regarding Property use and/or including without limitation any of the situations referred to in the preceding paragraph. The Client acknowledges that this exemption of liability will be subject exclusively to the jurisdiction of the judges and courts of the state of Quintana Roo, Mexico, expressly submitting to said jurisdiction and waiving to any other foreign forum and/or jurisdiction to which the Client may be entitled, due to his/her/their domicile or residence.
Confidentiality

The Client commits to maintain this document confidential and shall not disclose it to the media, legal or verdict and settlement publications or any other third parties if there is no jurisdictional requirement or without an official express authorization from PLAYAAKUN.

Cancellation & refund policy

In order for cancellation to be valid, we need a written request by you and a written confirmation of the cancellation by us. Cancellations made by phone are not valid.

* 25% non-refundable charge of the total amount on any cancellation.

* 75% non-refundable charge of the total amount if the client cancels 30 to 15 days prior to arrival date.

*100% non-refundable charge of the total amount if the client cancels 30 days or less prior to arrival date.
